This privacy statement sets out the ways in which we process any personal data we may collect about you when marketing our services to your business or carrying out our services, the basis on which we do so and the steps we take to safeguard your data.
Gain is a global digital marketing and experience agency, specialising in evidence-driven digital strategies, creative services, marketing services to enhance client and this privacy statement specifically covers our processing activities as a data controller, which is in relation to our marketing activities, such as contacting businesses we believe might benefit from our services.
All data captured and processed by Gain will be done so in accordance with the applicable Data Protection Laws, defined herein as the Data Protection Act 2018, the General Data Protection Regulation (GDPR), the UK GDPR and all other applicable laws and regulations relating to processing of personal data and privacy as amended and replaced, including where applicable the guidance and codes of practice issued by the UK Information Commissioner’s Office.
This privacy statement also covers personal data processed through Gain’s digital products and platforms, including AI-enabled tools, where Gain acts as a data controller. Where Gain processes personal data on behalf of customers as a data processor, this is governed by the relevant specific-product terms and applicable data processing addendums.
In respect of digital products, our role as data controller or processor will depend on the context in which personal data is processed.

We may provide your data to Experian for the purposes of receiving more information on the company you work for. This may include, but is not limited to, company revenue, company registered address and Thompson code.
We may provide your data to Hubspot, the provider of a CRM platform, for the purposes of storing your data and managing our contact with you.

Please note, where Gain has appointed sub-processors to carry out services on our behalf, we have ensured that they provide at least the same level of protection for your personal data as applied at Gain and demonstrate compliance with relevant Data Protection Laws. Gain also ensures that any transfers of personal data outside of the UK or EEA are made in compliance with the requirements of Data Protection Laws.
Research Participation and Reward Fulfilment
As part of our service, Gain may recruit individuals to take part in research studies, interviews, or other research activities. When doing so, we may collect and process limited personal data, such as your name, address and email address in order to manage your participation and to provide you with a reward or incentive (for example, a payment or voucher) for taking part.
To fulfil these rewards, we may use trusted third-party providers such as Wise (for direct payments) and Amazon (for digital vouchers). When using these platforms, your email address and payment details may be processed and stored securely within their systems as part of the transaction or order record. Please note that while Gain only accesses and uses this data for the purpose of fulfilling the reward, certain information (such as your email address within Amazon order records) may be retained by these third parties for their own record-keeping purposes and therefore may remain stored indefinitely in accordance with their privacy policies.
Both Wise and Amazon accounts used by Gain are password-protected and secured with appropriate technical and organisational measures to ensure your data is handled securely.

Gain ensures that any processing of personal data for research participation or reward fulfilment is carried out in accordance with applicable Data Protection Laws and only for as long as necessary to complete the study, distribute the reward, and meet any record-keeping obligations. Where personal data is retained within a third-party platform beyond Gain’s control, this is governed by that provider’s own data retention policy.
Collection of special category data
We may collect and process certain types of special category data (such as information about your health, ethnicity, or other sensitive personal data) where it is relevant to our research purposes. We will only collect this data with your explicit consent. This information will be handled in accordance with the applicable Data Protection Laws. You have the right to withdraw your consent at any time.
Retention of recordings of research sessions
Research sessions may be recorded (audio and/or video). These recordings are processed and stored via secure third-party platforms such as Zoom or Microsoft Teams, in line with their respective security standards.
Recordings will only be accessed by authorised members of the research team and will be retained for no longer than necessary to fulfil the research purpose, typically two years, after which they will be securely deleted. Where possible, identifiable information will be removed or anonymised during transcription and analysis.
BACS payments
Where payments or incentives are issued directly by Gain (rather than through third-party providers), we may collect the necessary banking details (such as account name, sort code, and account number) to process your payment via BACS. This information will only be used for payment purposes, will be shared securely with our finance team, and will be deleted once the transaction has been completed and financial records have been reconciled in accordance with statutory accounting requirements and Data Protection Laws.

Your data protection rights
In line with the Data Protection Laws, you have certain rights in relation to your personal data, although these rights are not absolute and therefore, they will not apply in all circumstances.

Personal data used for reward fulfilment will be deleted once this purpose has been fulfilled except where retention is required by law.
Please note that if you opt-out of marketing we will retain a record of your data to ensure that you do not receive any future marketing from us.
Please note, if you have made a request for us to erase your data, we will still store enough information necessary for us to ensure that you are not contacted again; this will be held in a suppression list.
